Guide To Zoning Terms

New York City’s zoning laws can be confusing, but our expert agents can help you understand theregulations for any commercial property. Here’s a quick guide to some of the abbreviations commonlyshown on listings:

Districts

Land in all five boroughs is divided into zoning districts that are regulated by NYC’s Department of City Planning. There are three types of zoning districts, which are further subdivided based on the density of people or types of land use permitted in that district. For example, R1 districts consist of mostly detached, single-family homes, such as the Todt Hill neighborhood. R10 is the
highest-density residence district type, and portions of Midtown and Lower Manhattan are mapped at this density. Zoning districts include:

  • Commercial Districts (C) range from C1 to C8.
  • Manufacturing Districts (M) range from M1 to M3.
  • Residence Districts (R) range from R1 to R10.

There also are a few Special Purpose Districts that have unique regulations. For example, the Special St. George District (SG) on Staten Island is regulated to preserve waterfront views, maintain ground-floor commercial use on commercial streets, and keep the area pedestrian-friendly.

Non-Conforming Use

Some commercial buildings were constructed before NYC’s current zoning resolution went into effect. These buildings may have features that classify them as “non-conforming use.” For example, a zoning district may impose a height limitation on new buildings, but existing buildings that surpass the height restriction don’t have to be torn down — they’re allowed to remain as a pre-existing, non-conforming use area. Although these buildings are exempt, zoning laws generally try to prevent an increase in the degree of non-conformance.
